Fair Housing Complaint re Gov Newsom

[Editor note: There are numerous complaints pending with the state Department of Fair Employment and Housing.

The Equal Protection Clause is located at the end of Section 1 of the Fourteenth Amendment:

All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws. [emphasis added]

These are actual signed complaints, not intakes. One set is the Housing complaints, the other set is Unruh complaints. The separate Housing Complaints name The Los Angeles Housing and Code Enforcement, the City Attorney’s office, state employee Kevin Kish, state employee Gavin Newsom, state employee Colleen Janetpour. The Unruh complaints concerning the city election of 2020 March, name Mark Ridley-Thomas, Los Angeles County Board Of Supervisors, League of Women Voters, Adams Neighborhood Council, Ethiopian Democratic Committee, First African Methodist Episcopal Church, and Holman Methodist Church. It is anticipated that the DFEH under Newsom, hypocritical at best, will take little action, and the Complaints will be the subject of an attack on the city’s abuse of federal funds for use of racial discrimination.  The state of California government was sued in 2016 for housing discrimination and systemic racism. The DEFH has since then not instituted any reforms, does not recognize continuing damages due to racism, and has written that it does not understand what is the causal relationship between a landlord and a tenant. Someone at the DFEH needs to be replaced.)

I object to your decision.
It violates your duty under the Fourteenth Amendment to the Constitution and is prohibited.
Your position indicates it is ok to lynch some Blacks, as long as the DFEH did not lynch ALL Blacks. Your position is without merit.

Newsom DFEH Refuses to Protect the Rights of All Blacks

I disagree with your position.
I will be filing a New Complaint.
As we discussed, all Blacks of my race were to be excluded from “full and equal privileges” by the Respondent because they were not on the ballot and write-in candidates; this is unlawful under Unruh. The DFEH has failed to protect “all persons” and “all persons” means all Black persons, not just the Black persons that the DFEH Newsom decided who should have full and equal privileges. Basically your decision under Newsom and Kish is saying that all Blacks are not entitled to “full and equal privileges” and that is not what the Unruh act says. The DFEH and the Respondent support the fact that I was not a candidate that was on the ballot; therefore the DFEH under Newsom and Kish and the respondent segregated me into a category for the intention of denying me full and equal privileges as a Black write-in candidate who under federally CFR was a legally qualified candidate; your decision states “others of my race were granted the services you requested”; others of my race, Black write-in candidates, were not granted the services I was denied. I remind you that at the time the Respondent denied me campaign publicity and a turn at the podium, claiming I was not on the “ballot”, there was no ballot.

You state, “being a write-in candidate is not a protected basis under the laws we have authority to enforce”. Under Unruh “all persons” are protected, not just those under a protected category. The DFEH also has authority to investigate the Respondent as “arbitrary discrimination” but the DFEH has failed to do so. Therefore the DFEH does have authority according to your own flyer published to the internet. The DFEH obviously does not practice that All Black Lives Matter. I might as well have been lynched and the DFEH would offer no protection. The DFEH needs to be 100% defunded so that Blacks can take their grievances to the streets.

“I might as well have been lynched and the DFEH would offer no protection…”

Los Angeles- Instead of being part of the solution, Governor Gavin Newsom’s Department of Fair Employment and Housing (“DFEH”) is part of the problem.

Numerous complaints have been filed against the DFEH and Newsom, the latest dated June 6, 2020 by email to the DFEH, but the DFEH said thru emails from state employees David Burke and Shaynak Williams, that the DFEH does not have the authority to investigate a discrimination complaint against Governor Newsom and the DFEH. Apparently Newsom is saying that equal rights do not apply to all Blacks. The eight page complaint from a Black Los Angeles resident against Newsom and the DFEH arose after the DFEH refused to investigate housing discrimnation in a Los Angeles rent control building and housing discrimination complaints lodged against the city government of Los Angeles and code enforcement department and rent control department. The Newsom and Kish complaints were given DFEH case numbers 202003-09560610 and 202003-09560910.

Complainant was entitled to housing services intercom maintenance and tandem parking, and money damages, the same as similarly situated white citizens.

Complainant met all qualifications as a rental tenant to receive housing services intercom maintenance and tandem parking, and money damages, the same as similarly situated white citizens.

Complainant was denied money damages, housing services intercom maintenance and tandem parking, by the issuance of a DFEH intake closure dated February 5, 2020

After the denial of housing services to Complainant, the DFEH and Governor Gavin Newsom continued providing services to those persons of the white race who reside at the 1522 Hi Point St 90035 address

This has been redacted. The Complaint is dated Feb. 5, 2020 and received by the DFEH on same date. The Complaint is eight pages, the Intake form is five pages long. Similar complaints have been filed against Kevin Kish and Colleen Janetpour.
